The ban on #InternationalStudents would also impact #HarvardLaw's Juris Doctor [the graduate program for every #lawyer in the #US] & Doctor of Juridical Science programs. Each #JD class of 560 typically includes 45 to 50 intl students—about 9%—for a total of about 150 #students spread across 3 classes. The #SJD, which is for aspiring #legal #academics & typically has ~60 people enrolled, also draws heavily from overseas.

The vast majority—97% this year—come from outside the US, & its grads have gone on to serve in foreign govts, courts & other key positions around the world.
Those #LLM #students would be shut out entirely under #Trump's #InternationalStudents ban. Tuition for the LLM program at #Harvard is set at $80,760 next year, acc/to the school's website. With ~52% of LLM students receiving some need-based #grants, the program likely generates about $11M in tuition.

Federal Judge Burroughs has extended her order blocking the #Trump admin’s attempt to bar #Harvard University from enrolling foreign students. US District Judge Allison Burroughs granted Harvard’s request for a preliminary injunction, blocking the govt’s action until the case is decided. It had already been paused since last week, when Burroughs issued a temporary restraining order.

Claiming #Harvard failed to fully comply with their likely extralegal demands, the admin moved last week to revoke its ability to host #InternationalStudents.

So now it is giving Harvard 30 calendar days to provide written documentation & other evidence “to rebut the alleged grounds for withdrawal.”

The filing *appeared* to try to correct an obvious violation of the #law when it abruptly announced revocation of #Harvard’s #SEVP certification w/o proper process.
But the 30-day delay does little to address the core questions in the case.
The #Trump admin has sought extensive documentation from Harvard, requesting, among other things, coursework for EVERY international student & information on any #StudentVisa holder involved in misconduct or *illegal* activity.

The #Trump admin’s filing giving #Harvard 30 days to respond w/evidence showing why the admin should not make good on its threat to bar it from enrolling #InternationalStudents appears to be a legal maneuver to delay, if not change, the ultimate outcome in the case.
Judge Burroughs had already temporarily stopped the federal govt from the move, & the sides were taking part in a hearing this morning to review extending her injunction.

#DHS’s move would prevent #Harvard from enrolling new #InternationalStudents & require existing ones to transfer to other #schools or lose their #legal status.

#Trump told reporters in the Oval Office on Wednesday that #HarvardUniversity should have a 15% cap on the number of non-U.S. #students it admits.

In a letter that day, Noem accused #Harvard of refusing to comply w/wide-ranging requests for information on its #StudentVisa holders…. [Though she cited no law or regulation that the university had violated]

Harvard, the nation's oldest & wealthiest #university, enrolled nearly 6,800 #InternationalStudents in its current school year, ~27% of its total enrollment.

The case before Judge Burroughs was filed after #KristiNoem revoked #Harvard's #SEVP certification to enroll non-US #students.

In announcing the decision, Noem, without providing #evidence, accused the #university of "fostering violence, antisemitism, & coordinating with the Chinese Communist Party." [#FigLeaf]

The #university's lawyers argued #DHS's action was part of an "unprecedented & retaliatory attack on #AcademicFreedom at #Harvard," which is pursuing a separate lawsuit challenging the admin's decision to terminate nearly $3B in federal #research #funding.

Harvard argues the #Trump admin is retaliating against it for refusing to accede to its demands to control the school's #governance, #curriculum & the #ideology of its #faculty & #students.

"We continue to reject #Harvard’s repeated pattern of endangering its students & spreading American hate—it must change its ways to be eligible to receive generous benefits from the American people," #DHS Secy #KristiNoem nonsensically said in a statement.

#Harvard has said losing that right would affect about ¼ of its student body & devastate the school. It has denied #Trump admin fig leaf charges of alleged bias against conservatives, fostering antisemitism on campus & coordinating with the Chinese Communist Party.

DHS claims it sent Harvard the notice after school ofcls indicated an intent to comply w/requirements of the federal #SEVP [but it already does so total BS].

#Harvard had argued that the revocation violated its #FreeSpeech & #DueProcess rights under the US #Constitution. In addition, Harvard contended that the revocation failed to comply with #DHS #regulations. The regulations required providing at least 30 days to challenge the agency's allegations & giving Harvard an opportunity to pursue an administrative appeal.

Secy of #State #MarcoRubio said in the cable that the dept plans to issue updated guidance on #socialmedia vetting of #student & #exchange visitor applicants after a review is completed & advised consular sections to halt the scheduling of such #visa appointments.

The move comes as the #Trump admin has sought to ramp up #deportations & revoke #StudentVisas as part of its wide-ranging efforts to fulfill his hardline #immigration agenda.
