Its lawyers are expected to seek to narrow prior court rulings & also defend against an anticipated rise in #ClassAction lawsuits challenging #Trump policies.

Lawyers in the unit are opposing 2 attempts by advocacy organizations to establish a nationwide class of people to challenge Trump's order on #BirthrightCitizenship. A judge granted one request on Thursday.

@X00001 #Nintendo kicking #Switch2 devices off their network for #ToS violations is one thing, and like the #Xbox360 that is justifyable.

  • However remotely #bricking devices is not, as Nintendo does not own these devices legally when they are rightfully sold to a consumer.

Even #Microsoft of all corporations knew that they cannot cross that line, and merely exclude #consoles from #Multiplayer and #Purchases but still allowing people to play their games.

I am not affected and most certainly won't buy a #NSW2 / #SW2 for that reason alone.

The process to certify a class can often take months. A snr White House ofcl told Reuters the #Trump admin will be watching #class certification decisions closely & plans to aggressively challenge them to prevent “abuse”of the process.

The govt says the named class plaintiffs in the New Hampshire case are too different from one another to be able to proceed as a #ClassAction. They include an #asylum seeker & someone on a #StudentVisa.

The plaintiffs in the NH #BirthrightCitizenship case are looking to seize upon one of the major exceptions to #SCOTUS’ ruling. They argue it allows #judges to continue to block #Trump policies on a nationwide basis in #ClassAction lawsuits.

The lawsuit, which was filed by the #ACLU & others hours after the Supreme Court ruled, seeks class action status on behalf of babies who would be subject to Trump's #ExecutiveOrder & their parents.

Many class action lawsuits related to data breaches get dismissed for lack of standing when plaintiffs cannot show concrete injury or imminent harm. Or when they do allege concrete harm like fraud or IDtheft, they may have trouble showing it was due to that specific #databreach and not any of a gadzillion other breaches that have occurred.

In Webb v. Injured Workers Pharmacy, the lower court dismissed the suit because it didn't think the plaintiffs made a clear enough showing of tracing the harm to the breach.

The appellate court reversed and remanded.

After that, the case settled for more than $1M.
