"It is infuriating to see another Labour government seek to appease a rightwing voter base by reinforcing the “tough on crime” doom loop that has gridlocked our justice system for the past 30 years. It was New Labour’s punitive posturing that drove up the prison population by 40% between 1997 and 2010"

The Guardian · Labour’s populist pantomime over sentencing rules plays into the hands of the rightBy Janey Starling

I'm slightly surprised the offender didn't get a whole life order in this case (3 #murders using an illegally obtained #firearm) even though he was young, but he will remain in #prison for longer than I am likely to be alive!

I still think there's an anomaly with #sentencing for #murder in #England / #Wales - those who target people known to them seem to get get shorter #sentences than those who attack strangers

I have waited until the #Court case and sentencing was finished before commenting on this (a legal requirement, you can get in a whole heap of trouble for not complying with it), but throughout I had suspected the defendant had a previous history of fighting and violence (disclosed in #sentencing, its not always disclosed to the jury during the case), as well as long term #alcohol and #drugs use (which can lead to impulsive behaviour) #crime #Darlington #murder

“Historic sentencing appeal at Royal Courts of Justice for 16 Just Stop Oil prisoners”

by Kate Bermingham in The Canary @thecanaryuk

“The prisoners include the ‘Whole Truth Five’, sentenced for four to five years each for participating in a zoom call about temporarily blocking the M25. These are the longest prison sentences ever handed down for nonviolent civil disobedience in the UK”

Unconditional discharge.

Make no mistake. Judge Merchan is a traitor to the American people and he just sold out our professed system of democracy. If the rule of law does not apply -- if there are no real consequences for the most powerful people in this country -- then the rule of law means NOTHING. There will be more vigilantes. More assassinations. Because the justice system is broken and now people know that they can get away with anything.

#Trump to Be Sentenced in NY #Criminal Case

The proceedings are set to begin at 9:30AM in Manhattan. Though the president-elect is expected to avoid #jail time, his #sentencing on 34 counts will formalize his status as a #felon & make him the first to carry that distinction into the White House.

The New York Times · Trump Is Sentenced in N.Y. Hush-Money Case and Will Avoid Jail: Live UpdatesBy Ben Protess
Continued thread

#Trump is set to be sentenced Friday, after a jury convicted him of 34 counts of falsifying business records related to a #HushMoney payment made to an adult-film actress during the 2016 election. #NY Supreme Court Justice Juan #Merchan, who presided over Trump’s trial, has said he does not plan to give the incoming president jail time or probation.

A divided #SCOTUS refused to delay #Trump’s #sentencing in his #HushMoney case, clearing the way for the president-elect to face judgment in a #NY courtroom on Friday & to be formally classified as a #felon before he returns to the #WhiteHouse.

Trump turned to the Supreme Court in a last-ditch effort to stop the hearing, citing the conservative majority’s explosive opinion in July that granted him & *other* former presidents #immunity from #criminal prosecution for their official acts.

@Nonilex

"who previously asked for the hearing to be postponed until after the election that Trump maintained he would win. After making that request, the judge said Trump could NOT now credibly say that winning the election makes him #immune from #sentencing."

The problem here is that this is exactly how and why the current #SCOTUS was constructed by #LeonardLeo and the #FederalistSociety

Points of law, the entire logic of existing law, are meaningless

The Supreme Court of the United States exists only to do what is needed to advance the far-right agenda

All references to #Textualism and #Originalism and the meaning of the law as it exists are a fraud

Not that any of that matters

…last wk, #Merchan wrote that he plans to order an “unconditional discharge” for #Trump, a designation in NY #criminal courts for a non-jail & non-probation sentence….

…the current sentencing schedule was requested by Trump, who previously asked for the hearing to be postponed until after the election that Trump maintained he would win. After making that request, the judge said Trump could NOT now credibly say that winning the election makes him #immune from #sentencing.

#NewYork’s high court tossed out #Trump’s #appeal of the #GagOrder in his #FalsifiedBusinessRecords / #ElectionInterference / #HushMoney #criminal case Thurs.

The gag order, which remains in partial effect ahead of Trump’s #sentencing, bars him from making public remarks about prosecutors involved in the case or their families.

In a brief order, the court said “no substantial #constitutional question is directly involved” & that it would dismiss Trump’s appeal.

The saga of #Trump’s #FalsifiedBusinessRecords #ElectionInterference #HushMoney case isn’t over yet

#Republican #Trump was hoping to delay his #NewYork #sentencing on 34 #felony counts until after the Nov 5 election, but a federal judge said Tues that he wouldn't block the case from moving forward.

NY State Judge Juan #Merchan is set to sentence Trump on Sept 18 in the Manhattan hush money case, after a NYC #criminal #conviction on May 30.
